1. Acceptance of Terms

By accessing or using zkVibe ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

zkVibe is a Solana wallet reputation and analytics platform that analyzes trading behavior, history, and performance to generate a "vibe score" and award badges. The Service is provided for informational purposes only and does not constitute financial advice, investment advice, trading advice, or any other sort of advice.

3. No Financial Advice

THE SERVICE IS NOT INTENDED TO PROVIDE FINANCIAL ADVICE. The information provided through the Service is for informational and entertainment purposes only. You should not construe any such information or other material as legal, tax, investment, financial, or other advice. Nothing contained on our Service constitutes a solicitation, recommendation, endorsement, or offer by zkVibe or any third party to buy or sell any securities or other financial instruments.

You alone assume the sole responsibility of evaluating the merits and risks associated with the use of any information or content on the Service before making any decisions based on such information. You agree not to hold zkVibe liable for any possible claim for damages arising from any decision you make based on information or content made available to you through the Service.

4. Risk Disclosure

Trading cryptocurrencies carries a high level of risk and can result in the loss of all your funds. Cryptocurrency prices are extremely volatile and may be affected by external factors such as financial, regulatory, or political events. Trading on margin increases the financial risks.

Before deciding to trade cryptocurrencies, you should carefully consider your investment objectives, level of experience, and risk appetite. The possibility exists that you could sustain a loss of some or all of your initial investment and therefore you should not invest money that you cannot afford to lose.

5. Wallet Analytics and Data

zkVibe analyzes publicly available blockchain data to calculate reputation scores and badges. By connecting your wallet to our Service, you authorize us to analyze your wallet's public transaction history on the Solana blockchain. All blockchain data is public by nature and can be accessed by anyone.

We do not and cannot access your private keys, seed phrases, or initiate transactions on your behalf. You maintain full custody and control of your wallet at all times.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Neither zkVibe nor any person associated with zkVibe makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Service.

zkVibe does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The reputation scores, badges, or analytics provided through the Service are accurate, reliable, or complete
• Any defects or errors will be corrected
• The Service or servers are free of viruses or harmful components
• Wallet analysis results reflect actual trading skill or future performance

7. Limitation of Liability

IN NO EVENT SHALL ZKVIBE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content
• Trading losses incurred as a result of using information from the Service
• Inaccurate reputation scores, badge calculations, or wallet analytics

8. Indemnification

You agree to defend, indemnify, and hold harmless zkVibe and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party
• Any trading decisions made based on information from the Service

9. User Accounts and Wallet Connection

When you connect your wallet or create an account with us, you are responsible for maintaining the security of your account and wallet, and you are fully responsible for all activities that occur under your account. You must immediately notify zkVibe of any unauthorized uses of your account or any other breaches of security.

zkVibe will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We do not store or have access to your private keys.

10. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of zkVibe and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

11. Blockchain Data

zkVibe aggregates and analyzes publicly available blockchain data. We do not control or modify blockchain data. All information derived from blockchain analysis is based on publicly available on-chain data and may not reflect the complete picture of a wallet's activity or intent.

12. Prohibited Uses

You may not use our Service:

• For any unlawful purpose
• To solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service
• To manipulate reputation scores or gaming the badge system

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be finally settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
